Terms & Conditions

These Terms and Conditions ("Terms") govern your participation in any workshop or event hosted by Bread For Better ("Organization"), a nonprofit organization registered in the state of Texas. By participating in the Workshops or events, you agree to be bound by these Terms. Please read them carefully before enrolling in or attending any workshop or event. This document is legally binding and affects your legal rights. By attending any Bread For Better workshop or event, you acknowledge that you have read these Terms and are accepting and agreeing to be bound and abiding by these Terms. By attending,  you also agree to release Bread For Better from all liability and forever giving up any claims therefore. If you do not agree to or accept any provision of these Terms, you should not enroll in or attend any workshop or event.

Media Release Waiver:

I consent to and authorize the use of any photographs or video recordings taken of myself or my household during our participation in Bread For Better's workshops or events. I understand that these images and recordings may be used in any format, including print, social media, and online by Bread For Better or companies in partnership or affiliation with Bread For Better. I release Bread For Better and its affiliates from any and all claims for invasion of privacy, libel, slander, damages, or any other claim based upon the use of the photographs or video recording. of myself or members of my household. I acknowledge these photographs or recordings may be used with or without advertising sponsorship

Eligibility:

1.1. You must be at least 18 years old to participate in the Workshops. Minors under the age of 18 may participate only with the consent and supervision of a parent or legal guardian.

1.2. By enrolling a minor in the workshops or by bringing a minor to an event, you represent and warrant that you are the parent or legal guardian of the minor and that you consent to their participation in the workshop or event. 


Registration and Enrollment:

2.1. To enroll in a workshop, you must complete the registration process through  www.breadforbetter.org or by any other means specified by the Organization.

2.2. The Organization reserves the right to accept or reject any registration in its sole discretion.

2.3. Once your registration is accepted, you will receive a confirmation email with workshop details, including the date, time, location, and any additional requirements or instructions.

Fees and Payment:

3.1. The workshop may require payment of a fee. The fee amount will be specified during the registration process.

3.2. All fees are non-refundable, except as otherwise stated in the cancellation policy and in these Terms or as required by applicable law.

3.3. You are responsible for providing accurate and up-to-date payment information. Failure to do so may result in the cancellation of your enrollment.

Workshop Conduct:

4.1. You are expected to conduct yourself in a respectful and appropriate manner during the Workshops.

4.2. You must comply with all instructions, guidelines, and safety protocols provided by the Organization or its representatives.

4.3. Any disruptive or inappropriate behavior may result in your removal from the workshop, without refund.


Intellectual Property:

5.1. All materials, recipes, techniques, and other intellectual property used or provided during the workshops and events are the exclusive property of the Organization or its licensors.

5.2. You may not reproduce, distribute, modify, or create derivative works from any materials provided during Bread For Better's workshops or events, including recipes and techniques, without prior written permission from the Organization. However, participants are encouraged to share what they've learned in a non-commercial, personal context to foster Bread For Better's community-building mission.

Assumption of Risk: 

6.1. While we prioritize safety and community care, participants accept and assume full responsibility for all risks related to workshops or events by attending. By joining us, you understand the importance of mutual responsibility in creating a safe, empowering learning environment. 

6.2. You agree that any use of Bread For Better facilities, services, equipment and premises, or use of other organization’s facilities, services, equipment and premises used by Bread For Better, and any participation in Bread For Better programs and activities comes with inherent risks including by way of example and not limitation: (1) moderate and severe personal injury, (2) property damage, (3) disability, (4) death, and (5) sickness or disease, (6) loss of profit. You understand that use of facilities and attendance in workshops and events may result in my exposure to and illness from infections diseases including but not limited to MRSA, influenza, and COVID-19. 

6.3. You understand that attending any Bread For Better workshop or event may involve being in kitchens or being around hazardous kitchen equipment and materials (e.g. hot ovens and trays).  

6.4. You assume any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, from any dangerous or defective equipment or property rented or utilized by Bread For Better, or because of their possible liability without fault. 

Limitation of Liability:

7.1. To the fullest extent permitted by law, the Organization, its employees, representatives, affiliates or their licensors, or volunteers shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising out of or related to your participation in the Workshops or events, and shall not be held liable for any damage, including but not limited to, personal injury, property damage, disability, death, sickness, distress, loss of profit, loss of data, or disease incurred by participants or their guests, including minors, during participation in our Workshops or events. 

7.2.  The Organization makes no warranties or representations regarding the accuracy, completeness, or reliability of any information or materials provided during the Workshops.

7.3. The accident waiver and release of liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.

Indemnification:

8.1. You agree to indemnify, defend, and hold harmless the Organization, its employees, representatives, affiliates or their licensors, or volunteers, from and against any claims, damages, losses, liabilities, costs, and expenses (including attorney's fees) arising out of or related to your participation in the Workshops or events or any breach of these Terms.

8.2. You agree to waive and covenant not to sue the Organization, its employees, representatives, affiliates or their licensors, or volunteers, from any cause of action, claims, suits, liabilities or demands of any nature whatsoever including, but not limited to, claims of negligence which you and any legal successors and proxies may have, now or in the future, on account of personal injury, property damage, loss of profit, loss of data, disability, or death, sickness, diseases or accident of any kind, arising out of or in any way related to the use of facilities or participation in programs, whether that participation is supervised or unsupervised, however the damage occurs, including but not limited to the negligence. 

Health Agreement: 

9.1. By attending a Bread For Better workshop or event, you consent to receive any immediate medical or emergency care for you or any member of your household in attendance, by a staff member or volunteer, which may be deemed advisable in the event of injury, accident, and/or illness. 

9.2. You agree to allow Bread For Better and its volunteers of affiliates, to share information concerning the medical condition / treatment of you or your minor child to medical personnel or others Bread For Better in its discretions determines is necessary to treat you or my child. 

9.3. By participating in any Bread For Better workshop or event, you acknowledge that you have read and agree to the terms of this Health Agreement. If you do not consent to these terms, you must notify us by email at info@breadforbetter.org at least 24 hours prior to the scheduled workshop or event, or your participation will be considered an acceptance of this agreement.

Governing Law and Venue:

10.1. These Terms shall be governed by and construed in accordance with the laws of the state of Texas, without regard to its conflict of laws principles.

10.2. Any dispute arising out of or relating to these Terms or the workshops shall be subject to the exclusive jurisdiction of the state and federal courts located in Texas.

Severability:

11.1. If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect.

Modifications:

12.1. The Organization reserves the right to modify or update these Terms at any time without prior notice. Any changes will be effective upon posting the revised Terms on the Organization's website or by other appropriate means.

12.2. Your continued participation in the workshops or events after the posting of any modifications constitutes your acceptance of the revised Terms.

Termination:

13.1 We reserve the right to not provide the Website or services to any person. We also reserve the right to terminate any user’s right to access the Website or services at any time, at our discretion. If you violate any of these Terms, your permission to use the Website and services automatically terminates. If you do not agree and accept these Terms, you must not access the Website.
